The rules of the road for using MarketChomp. This policy is part of our Terms of Service and works alongside our Privacy Policy.

About this policy

This Acceptable Use Policy sets out what is and isn’t allowed when you use MarketChomp. It’s part of our Terms of Service and works alongside our Privacy Policy.

It applies to everyone who uses the service, and to all the content you create, approve, publish, or send through it. If you break this policy, we may remove content, pause publishing, or suspend or close the account.

Opt-in audiences only

MarketChomp is built for permission-based marketing. You may only email or message people who have opted in to hear from you — for example, through your own website sign-ups or social-to-email funnels.

Don’t use the service to send unsolicited bulk messages (spam), and don’t bring in cold-contact or purchased lists. Every marketing email you send must make it easy to unsubscribe, and you must honor opt-out requests promptly.

One business per subscription, and fair use

Each subscription is for one business — your own. Don’t use MarketChomp to provide marketing services to other people or businesses, to post on behalf of third parties, or to run more than one business from a single subscription, unless we’ve agreed to it in writing.

Use the service at a normal, human scale. Don’t use bots, scripts, or other automated means to generate or publish content beyond what your plan is meant for, and don’t try to get around the limits of your plan.

Content you’re responsible for

Because you approve everything before it goes out, you’re responsible for the content you publish or send. It must be truthful, not misleading, and lawful where your business operates.

Only publish material you have the rights to use — including logos, images, product details, and especially customer testimonials and photos. Use a customer’s words or likeness only with their genuine permission; MarketChomp keeps customer testimonials and photos locked until you confirm a signed release, and you must not work around that.

Don’t impersonate other people or businesses, post fake or incentivized reviews, or present AI-drafted content in ways that deceive your audience.

Content that’s never allowed

Don’t use MarketChomp to create, publish, or send content that is illegal, fraudulent, or deceptive; that infringes someone else’s intellectual property or privacy; or that is hateful, harassing, threatening, or defamatory.

Also off-limits: sexually explicit material, content that exploits or endangers minors, promotion of violence or illegal goods and services, and false or unsubstantiated claims — including health, financial, or other regulated claims your industry’s rules don’t allow.

Follow the law and platform rules

You’re responsible for following the laws and professional advertising rules that apply to your business. MarketChomp’s built-in compliance research is a helpful tool, not legal advice, and it doesn’t move that responsibility off you.

When you connect a social network, website, email service, or other platform, you also agree to follow that platform’s own terms. Don’t use MarketChomp in a way that would breach them.

Honest use of the AI

Use the AI to help you market your own real business. Don’t use it to mass-produce spam or low-value filler, to generate content designed to mislead or manipulate, or to create material that violates the rules above.

Don’t try to misuse the AI features — for example, by attempting to extract our prompts or system instructions, or to make the AI produce prohibited content.

Protecting the service

Don’t try to break, overload, or interfere with MarketChomp or the systems behind it. That includes attempting to gain unauthorized access, probing for vulnerabilities without permission, scraping the service, or getting around usage limits, security, or authentication.

Don’t reverse-engineer or copy the service, resell or share your access without our permission, or use MarketChomp to build a competing product.

Use the service only through the interfaces and methods we provide.

Reporting abuse

If you come across misuse of MarketChomp, or content sent through it that breaks this policy, please tell us at hello@marketchomp.com so we can look into it.

What happens if this policy is broken

We’d always rather help you put things right. But Apptellio, LLC may remove content, pause publishing, or suspend or close an account when this policy is broken, when it’s needed to protect the service or other people, or when the law requires it — and, where it makes sense, we’ll let you know.

Changes to this policy

We may update this policy from time to time. If we make a meaningful change, we’ll update the date above and, where appropriate, let you know in the app. By continuing to use MarketChomp after a change takes effect, you agree to the updated policy.
