This agreement

These terms are the agreement between you and Apptellio, LLC (“MarketChomp,” “we,” “us”) for your use of the MarketChomp service — our website, web app, and mobile apps.

By creating an account or using the service, you agree to these terms. If you’re using MarketChomp on behalf of a business, you’re agreeing on that business’s behalf, and you confirm you’re allowed to do so. If you don’t agree, please don’t use the service.

What MarketChomp does

MarketChomp is an AI marketing assistant for small businesses. Based on the business profile you set up, it writes social posts, blog articles, ads, and emails in your voice, researches the advertising rules for your trade and location, suggests channels, and lines everything up for your approval.

You are always the last step. Nothing — not a single post, ad, or email — is published or sent until you approve it. MarketChomp has no auto-publish path.

We’re always improving the product, so features may change, be added, or be removed over time.

Your account

You must be at least 18 years old and able to enter into a contract to use MarketChomp.

You’re responsible for keeping your login details secure and for everything that happens under your account. Please give us accurate information when you sign up and keep it current. Let us know promptly at hello@marketchomp.com if you think someone has accessed your account without permission.

Free trial, plans, and billing

MarketChomp offers a free trial. After the trial, continued use requires a paid plan. We offer several plans, billed monthly or annually, and the current options and prices are shown on our site.

Paid plans renew automatically for the same period until you cancel. You can cancel at any time, and your plan stays active through the end of the period you’ve already paid for. Except where the law requires otherwise, payments already made are non-refundable.

You can buy and manage your subscription on the web. The mobile apps let you use a subscription you already have, but don’t sell subscriptions. If we change our prices, we’ll give you notice before the change affects you.

Your content and your responsibility

You decide what gets published. Because every piece of content passes through your approval, you’re responsible for what you choose to approve, publish, or send — including making sure it’s accurate, appropriate for your business, and lawful where you operate.

You keep ownership of your business information and the content you approve. You give us permission to use that material as needed to run the service for you — for example, to generate drafts, store your content, and send approved content to the platforms you connect.

You confirm you have the rights to anything you put into MarketChomp — including logos, photos, customer testimonials, and product details — and that using it through the service won’t infringe anyone else’s rights.

AI-generated content

MarketChomp uses AI to create drafts. AI can make mistakes — it may occasionally produce content that’s inaccurate, outdated, or not quite right for your situation. That’s exactly why the approval step exists: please review every draft before you approve it.

We don’t guarantee any particular marketing result, level of reach, engagement, or revenue from using the service.

Compliance research is a tool, not legal advice

MarketChomp researches advertising rules for your occupation and location and builds guardrails into the content it drafts. This is a helpful tool to reduce risk — it is not legal advice, and it isn’t a substitute for a lawyer or for your own judgment.

You remain responsible for following the laws and professional rules that apply to your business. If you’re unsure whether something is allowed, check with a qualified professional before you publish it.

Connected accounts and third-party services

To publish or send your approved content, MarketChomp connects to accounts you choose — such as your social media profiles, your website, or your email service provider. Those services have their own terms, and your use of them is between you and them.

You’re responsible for having the right to use the accounts you connect and for keeping them in good standing. We aren’t responsible for a third-party platform changing its rules, limiting access, or going down.

Acceptable use

How you use MarketChomp — including the content you create, approve, publish, or send — must follow our Acceptable Use Policy, which covers opt-in audiences only (no spam or purchased lists), the content that’s never allowed, honest use of the AI, and keeping the service secure.

Our intellectual property

The MarketChomp software, design, and brand are owned by Apptellio, LLC and our licensors. These terms don’t give you any rights to our name, logo, or software beyond using the service as intended.

Helping us out — submitting feature requests, taking part in beta testing, or participating in product promotion (such as our Referral, Affiliate, or Partner Programs) — doesn’t give you any intellectual property rights or other benefits beyond those we specifically offer for that activity.

Suspension and cancellation

You can cancel your account at any time. We may suspend or end your access if you break these terms, if it’s necessary to protect the service or others, or if we’re required to by law.

If your account ends, your right to use the service stops. We’ll handle your data as described in our Privacy Policy.

Disclaimers

MarketChomp is provided “as is” and “as available.” To the fullest extent the law allows, we don’t make warranties of any kind about the service — including that it will be uninterrupted, error-free, or fit for a particular purpose.

Limitation of liability

To the fullest extent the law allows, Apptellio, LLC won’t be liable for indirect, incidental, or consequential losses — such as lost profits, lost data, or lost business — arising from your use of the service.

Where we are found liable, our total liability is limited to the amount you paid us for the service in the 12 months before the event that gave rise to the claim.

Changes to these terms

We may update these terms from time to time. If we make a meaningful change, we’ll update the date above and, where appropriate, let you know in the app. By continuing to use MarketChomp after a change takes effect, you agree to the updated terms.
